1.) ACCEPTANCE OF TERMS

Desktop Shark would like to welcome you to our site. The following terms and conditions will be updated at our discretion at anytime without notice to you. By using our website you are agreeing to our terms of service and are bound to the provisions provided herein.

2.) DESCRIPTION OF DESKTOP SHARK SERVICES

Desktop Shark website (website) provides a collection of tools to be used by its registered users. As such, all programming and code provided by the website is provided AS-IS. Our users acknowledge that Desktop Shark is not responsible for any mis-use of the website or tools provided. All activity on the website should be deemed as the sole responsibility of its users. We cannot be held responsible for what our users do, therefore it is up to the users to follow our guidelines and perform within the laws governing. Our services include but are not limited to the website and any software created by Desktop Shark or its affiliates.

3.) USER REGISTRATION OBLIGATIONS

By registering with Desktop Shark you represent that you are of legal age to form a binding contract and are at least 18 years of age. You also agree to provide true and accurate information about your identity when prompted to do so in our "Account Registration Form". Should Desktop Shark find reason to believe that any information provided is inaccurate or misleading then we reserve the right to suspend or terminate your account at any time. Furthermore, due to the inability for Desktop Shark to control the nature of content uploaded by its users, you agree to not allow or participate in allowing anyone under the age of 18 to view or access the website in any way.

4.) PRIVACY POLICY

By submitting data to our website in any way, you are aware of the threats of passing data over the internet regardless of how secure a connection. Furthermore, you are confirming that these threats may exist and Desktop Shark is not responsible for any exposed information outside of our control. However, we agree not to share information about our users unless one of the following conditions are met, 1.) We are asked to do so by court order. 2.) A government or higher power orders us to. 3.) Employees or hired services require access. 4.) Ownership of Desktop Shark is transferred to another party. 5.) We are provided written or verbal consent by you to do so. 6.) The owner decides it to be necessary.

5.) ACCOUNT SECURITY

Upon registration with Desktop Shark you will be required to create a password. This password is the responsibility of the user to maintain confidentiality and keep hidden. Furthermore, you agree to notify Desktop Shark of any breach of security or uninvited access to your account. You are also required to exit each session after using the website. Desktop Shark cannot and will not be held responsible for any liability for loss or damages arising from your failure to comply with this section.

6.) CODE OF CONDUCT

By using our website you are agreeing to our code of conduct. You are also agreeing to comply with Federal and State Laws of the United States government (governing body). You may terminate your account with Desktop Shark at any time. Furthermore, Desktop Shark may terminate your account at any point for any reason. Should you decide to terminate your account it is your responsibility to use the features provided in order to deactivate the account or contact us to do so.

8.) PROPRIETARY RIGHTS

All provisions provided by the Desktop Shark website (website) are considered to be property of Desktop Shark and protected under copyright laws. Any use of articles or provisions of the website is not allowed unless written permission is received by the owner of Desktop Shark.

Under no circumstances should any outside parties use our website, software, or proprietary works for personal gain unless granted written permission by the owner of Desktop Shark.

Our software is distributed and licensed "as is" without warranty or any guarantee by Desktop Shark, LLC as to the performance or features provided therein. Under no circumstances shall Desktop Shark be held liable for DAMAGES or MISUSE of the software including financial, physical, emotional, or in any other ways not listed. IT IS ILLEGAL TO INSTALL monitoring software on computer's that you DO NOT OWN and we cannot be held responsible for malicious users. We will openly comply with law enforcement officials to provide any information necessary to convict such users should this happen.
